RES 16-001RESOLUTIONNO.16-001ARESOLUTIONapprovingaDevelopmentAgreementbetweentheCityofCamasandKate’sCloseLLC.WHEREAS,Kate’sCloseLLCistheownerofcertainrealpropertylocatedwithintheCityofCamas;andWHEREAS,thepartieshavenegotiatedaDevelopmentAgreementrelatingtosaidpropertyandtheconstructionofcertainimprovementsonBradyRoad;andWHEREAS,theDevelopmentAgreementsetsforthcertaindevelopmentstandardsthatwillgovernthedevelopmentofthepropertyandtheCity’sassumptionofconstructionoftheBradyRoadimprovementsinconsiderationofCityacquisitionofpropertycontrolledbyKate’sCloseLLC;andWHEREAS,theCityCouncilhasconductedapublichearingontheproposedDevelopmentAgreementonDecember21,2015,atwhichtimeitconsideredtestimonyfromallinterestedparties;andWHEREAS,theCityCouncilfindsthattheagreementhasbeenreviewedbytheDirectorofCommunityDevelopmentandhasbeenfoundtomeetapplicableplanningrequirements;andWHEREAS,theCityCouncildesirestoapprovetheDevelopmentAgreementandauthorizetheMayortosigntheAgreementonbehalfoftheCity.NOW,THEREFORE,BEITRESOLVEDBYTHECOUNCILOFTHECITYOFCAMASASFOLLOWS:IThatcertainDevelopmentAgreementbetweentheCityofCamasandKate’sCloseLLC,relatingtocertainrealpropertylocatedwithintheCity'smunicipalboundaryisherebyapproved.TheMayorisauthorizedandinstructedtosigntheagreementonbehalfoftheCity.
