RES 1228RESOLUTION NO.
A RESOLUTION authorizing the Mayor to execute on behalf of
the City an exclusive Franchise Agreement with Waste Connections of
Washington ,Inc.for solid waste collection service in various areas
annexed to the City of Camas.
WHEREAS,RCW 35A.14.900 provides that a solid waste collection franchise in
unincorporated areas is cancelled upon annexation;and
WHEREAS,RCW 35A .14.900 further provides that the annexing City grant a minimum of a
seven (7)year franchise extension to any business whose franchise was extinguished by annexation;
and
WHEREAS,the law further provides that there is a requirement to provide additional
compensation to a business whose franchise was extinguished in this manner for the eventual loss of
the franchised area;and
WHEREAS,the City of Camas has annexed various areas with effective dates from and after
November 20,2011;and
WHEREAS,the City and Waste Connections of Washington ,Inc.have negotiated a
resolution acceptable to both parties and consistent with RCW 35A .14.900 and desire to have this
Agreement memorialized in the Exclusive Franchise Agreement hereto.
NOW,THEREFORE,BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAMAS
AS FOLLOWS:
SECTION I
The City hereby approves the "Exclusive Franchise Agreement for Solid Waste Collection
Service in Area Annexed to the City "attached hereto as Exhibit "A"and hereby authorize the Mayor
of the City of Camas to execute the same on behalf of the City of Camas.
ADOPTED at a regular meeting of the Council of the City of Camas this //—day of January ,
