RES 1141RESOLUTION NO .\\^\ A RESOLUTION setting a public hearing concerning the proposed vacation of a portion of NW Couch Street. WHEREAS,the City has received a request from the owners of Lot 6,Block 2 of Wolfs Addition to Camas,and that property vacated by Camas Ordinance 886,to vacate a portion of NW Couch Street,and WHEREAS,the portion of NW Couch Street to be vacated is abutted on the west and east sides by said owners,and WHEREAS,the Council of the City of Camas desires to initiate vacation proceedings for the street to be vacated,and WHEREAS,it is necessary for the Council to fix a time and place for a public hearing to be held on the proposed street vacation, NOW ,THEREFORE,BE IT RESOLVED BY THE COUNCIL FOR THE CITY OF CAMAS AS FOLLOWS: Section I The Council of the City of Camas does hereby initiate proceedings to vacate the following described portion of NW Couch Street as described in Exhibit “A ”,description #3,attached hereto and by this reference incorporated herein. Section II A public hearing shall be held on the proposed vacation on the 2nd day of March 2009,at 7:00 p.m.in the Council Chambers of the City Hall. Section III The City Clerk is directed to give twenty (20)days notice of the hearing by posting written notice in three (3)of the most public places in the City of Camas,by posting a like notice on that portion of the street to be vacated, and by mailing notice to the abutting property owners at least fifteen (15)days prior to the date of hearing. ADOPTED at a regular session of the City Council of the City of Camas this 20th day of January 2009. SIGNED: Mayor ATTEST : ( #1 -LOT 6,BLOCK 2 WOLF’S ADDITION TO CAMAS That portion of the Northwest quarter of the Northwest quarter of Section 11,Township 1 North,Range 3 East of the Willamette Meridian,described as follows: BEGINNING at a point 830.88 feet South and 297.5 feet East of the Northwest comer of said Section 11;thence East 55.5 feet;thence South 100 feet;thence West 55.5 feet; thence North 100 feet to the point of beginning,also known as Lot 6,Block 2 WOLF’S ADDITION TO CAMAS,an unrecorded subdivision. #2 -ORDINANCE 886 -VACATION A portion of the Northwest quarter of the Northwest quarter of Section 11,Township 1 North,Range 3 East of the Willamette Meridian,described as follows: BEGINNING 855.88 feet South and 373 feet East of the Northwest comer of said Section 11 ;thence East 20 feet;thence South 75 feet;thence West 20 feet;thence North 75 feet to the point of beginning,said tract being the East half of a portion of N.W. Couch Street,as vacated under Ordinance Number 886. Easement for utility purposes 25 feet in width,the centerline of said easement being the centerline of N.W.Couch Street,as reserved by the City of Camas,providing that the City shall not be responsible to abutting property owners for any and all damage to any improvements made by said owners upon said right of way due to the City’s constructing, maintaining and repairing of any and all utilities that may be hereafter constructed and maintained over,under or along said easement,as provided by Ordinance Number 886 of the City of Camas. #3 -PROPOSED RIGHT-OF-WAY VACATION A portion of the Northwest quarter of the Northwest quarter of Section 11,Township 1 North,Range 3 East of the Willamette Meridian,described as follows: Beginning at a point 830.88 feet South and 297.5 feet east of the Northwest comer of said Section 11,said point also being the Northwest comer of Lot 6,Block 2 of Wolf s Addition to Camas;thence East 55.5’to the Northeast comer of said lot;thence south along the east line of said lot 25 feet to the TRUE POINT OF BEGINNING;thence East 20 feet to the Northwest comer of the right-of-way that was vacated by the City of Camas by Ordinance Number 886;thence South 75 feet along said vacated right-of-way line to the Southwest comer of said vacated right-of-way;thence West 20 feet to the Southeast comer of said lot 6;thence North 75 feet along the East line of said lot 6 to the TRUE "A "POINT OF BEGINNING.EXHIBIT PAGE i OF Z
