July 1 , 1992 . 2 . Parties . This Agreement is entered into by and between the undersigned counties, cities and towns, political subdivisions and municipal corporations of the State of Washington. 3 . Recitals . A. Section 134(b) of Title 23 of the United States Code and sections 1024 and 3412 of the Intermodal Surface Transportation Efficiency Act of 1991 (ISTEA) requires a Metropolitan Planning Organization ( "MPO" ) to be designated for each urbanized area of more than 50,400 population by agreement among the Governor of the State of Washington and the units of general purpose local governments which together represent at least seventy-five percent (75%) of the affected population within the urbanized area. B. The purpose of an MPO is to develop transportation plans and programs for urbanized areas which will provide for the development of transportation facilities as part of an intermodal transportation system for the state, the metropolitan areas and the United States . C. By action of the Governor of Washington on January 2, 1979, the Regional Planning Council of Clark County, later known as the Intergovernmental Resource Center, was designated the MPO for the Clark County region. D. Section 134 (5) of Title 23 of the United . State Code permits the Governor to redesignate an MPO by agreement with the units of general purpose local governments in the urbanized area which together represent at least seventy-five percent (75%) of the affected population (including the central city or cities as defined by the Bureau of Census) . E . Because Clark County is a transportation management area, the MPO for this area is to include local elected officials, officials of agencies which administer or operate major modes of transportation in the metropolitan area (including all transportation agencies) , and appropriate state officials . INTERLOCAL AGREEMENT 1 01745001.D01 (06/02/92) F . According to Washington law, Chapter 47 . 80 of the Revised Code of Washington (RCW) enacted in 1990 authorizes the creation of a regional transportation planning organization ( "RTPO" ) to facilitate coordination and cooperation for the development of a planning program for regional transportation systems and facilities within the state . G. Section 47 . 80 . 020 RCW provides that in urbanized areas , the RTPO is the same as the MPO designated for federal transportation planning purposes . H. Washington governmental agencies are authorized pursuant to Chapter 39 . 34 RCW to enter into any agreement with any agency, political subdivision, or unit of local government of this state for joint or cooperative action. I . The parties to the Agreement desire to jointly and cooperatively enter into this Agreement aiid create an RTPO and MPO pursuant to the provisions of this Agreement. NOW, THEREFORE, THE PARTIES DO HEREBY AGREE AS FOLLOWS : 4 . Purpose. The purpose of this Agreement is to establish the Southwest Washington Regional Transportation Council which shall operate both as the RTPO and MPO for the southwest Washington region. 5 . Non-profit Corporation. The parties to this Agreement hereby authorize the Intergovernmental Resource Center, a quasi-municipal corporation, to facilitate the creation of the Southwest Washington Regional Transportation Council as a nonprofit corporation whose Board members shall include representatives of the participating public agencies which are signatories to this Agreement. The structure and organization of the Southwest Washington Regional Transportation Council shall be further defined in its Bylaws . 6 . Mission of the Southwest Washington Regional Transportation Council . The mission of the Southwest Washington Regional Transportation Council shall be to encourage and promote the development of a regional transportation system that efficiently maximizes the mobility of people and goods within and through the region and minimizes transportation air pollution. 7 . The parties to this Agreement shall be among those represented on the Board of Directors of the Southwest Washington Regional Transportation Council . Such parties may include any general purpose government, special purpose district, governmental agency, or political subdivision which is a party or becomes a party to this Agreement and agrees to fund the Southwest Washington Regional Transportation Council pursuant to the INTERLOCAL AGREEMENT - 2 01745001.001 (06/09/92) provisions of this Agreement and the Bylaws of the Southwest Washington Regional Transportation Council. The composition of the initial Board shall be as follows : A. Three Clark County Commissioners. B. One elected official from Klickitat County. C. One elected official from Skamania County. D. Two representatives from the City of Vancouver; ( 1) One City Council Member (2) City Manager E. One elected official from the City of Camas or the City of Washougal representing Camas and Washougal . F. One elected official from the City of Battle Ground, the City of Ridgefield, the Town of LaCenter or the Town of Yacolt representing Battle Ground, Ridgefield, LaCenter and Yacolt. G. One port commissioner from the Port of Vancouver, Port of Ridgefield or the Port of Camas-Washougal representing these three ports . H. The Executive Director of the Clark County Public Transportation Benefit Area (C-TRAN) . I . The District #4 Administrator of the Washington State Department of Transportation. J. The Portland Regional Administrator of the Oregon Department of Transportation. K. One council person from the Metropolitan Service District of Portland, Oregon. Those general purpose local governments which are part of the Southwest Washington Regional. Transportation Council and which together represent at least seventy-five percent (75%) of the affected population within the urbanized area in this region shall operate as the MPO. These local governments plus the agencies listed above shall operate as the RTPO. The role of the Directors and other applicable provisions relating to the Directors shall be set forth in the Bylaws of the Southwest Washington Regional Transportation Council. For those INTERLOCAL AGREEMENT - 3 01745001.DOI (06/09/92) Board members representing several agencies or for board positions to be filled from a pool of more than one person, the agencies so represented shall determine among themselves who shall represent them on the Board. 8 . Duties of the Skj2, Q. As an RTPO and MPO, the Southwest Washington Regional Transportation Council shall : A. Maintain a process for developing pians and programs that consider all modes of transportation and is continuing, cooperative, and comprehensive. B. Ensure that interstate transportation issues are coordinated between Washington and Oregon. C. Certify that the transportation elements of comprehensive plans adopted by counties , cities, and towns within the region conform with the requirements of §36 . 70A. 070 RCW, including any amendments thereto or recodification thereof, and are consistent with regional transportation plans as provided for in section 8 (D) of this Agreement. D. Develop and adopt a regional transportation plan that is consistent with the comprehensive plans of the counties, cities , and towns within the region and the state transportation plans . The Southwest Washington Regional Transportation Council shall use the comprehensive plans of the County, cities, and towns of the region as the basis of its regional transportation plan whenever possible. Such pians shall address existing or planned transportation facilities and services . E . Shall be the lead planning agency to coordinate preparation of the regional transportation plan. F . Review the regional transportation plan biennially for currency. G. Forward the adopted plan, and documentation of the biennial review of it, to the state department of transportation. H. Prepare and update periodically, according to a schedule, a long range plan for the region in accordance with ISTEA and other applicable laws . The long range plan shall at a minimum: INTERLOCAL AGREEMENT -- 4 01745001.001 (06/09/92) ( 1 ) identify transportation facilities that should function as an integrated metropolitan transportation system. (2) include a financial plan that demonstrates how the long-range plan can be implemented. ( 3) assess capital investment and other measures necessary to ensure the preservation of the existing metropolitan transportation system and to make the most efficient use of existing transportation facilities to relieve vehicular congestion and maximize the mobility of people and goods . (4 ) indicate, as appropriate, proposed transportation enhancement activities . I . Coordinate the development of a long range plan with the process for development of the transportation control measures of the State Implementation Plan required by the federal Clean Air Act. J . Provide citizens, affected public agencies , representatives of transportation departments and other interested parties with a reasonable opportunity for comment on the long range plan. K. Develop a Transportation Improvement Program for the area . The Transportation Improvement Program shall include: ( 1 ) a priority list of projects and project segments to be carried out within each 3-year period after the initial adoption of the Transportation Improvement Program. (2) a finance plan that demonstrates how the Transportation Improvement Program can be implemented. L. Develop a congestion management system that provides for effective management of new and existing transportation facilities eligible for funding under ISTEA and the Federal Transit Act through the use of travel demand reduction and operational management strategies . M. Exercise any and all powers permitted by law and necessary to carry out the duties of an RTPO and MPO. 9 . Funds . Appropriations from the state and federal government are to be provided as defined and authorized in state and federal law_ The Southwest Washington Regional Transportation Council is INTERLOCAL AGREEMENT - 5 01745001.D41 (06/09/92) authorized to seek local, state and federal funding and funding from private sources as may be necessary or of benefit to the Southwest Washington Regional Transportation Council; provided that each of the participating public agencies who are parties to this Agreement are authorized by law to receive such funds . Any public agency which is a party to this Agreement may appropriate funds and may sell, lease, give or otherwise supply the Southwest Washington Regional Transportation Council created pursuant to this Agreement by providing such personnel or services therefor as may be within its legal power to furnish. The Southwest Washington Regional Transportation Council may contract on a fee-for-service basis with the parties to this agreement and with non-party agencies and private entities which will provide special services . Notwithstanding the foregoing, all agencies which are a party to this Agreement shall pay dues and special assessments as established by the Board. 10 . Re Tonal Transportation Policy Board. Pursuant to §47 . 80 . 040 RCW, each RTPO shall create a regional transportation policy board (RTPB) . The RTPB shall provide policy advice to the RTPO. A Representative of major employers within the region shall be a member of the RTPB. The RTPB shall include the transportation policy committees in Clark, Skamania and Klickitat counties . The membership and duties of the RTPB shall be further defined in the Bylaws of the Southwest Washington Regional Transportation Council . 11 . Duration. This Agreement shall become effective upon the approval by resolution, ordinance or otherwise pursuant to the law of the governing bodies of all the parties to this Agreement . This Agreement shall remain in full force and effect perpetually or until terminated by seventy-five percent ( 75%) of the agencies which are parties to this Agreement. 12 . Amendments . Amendments to this Agreement may be proposed by any party to the Agreement and shall be considered by all parties upon recommendations by the Board of the Southwest Washington Regional Transportation Council . This Agreement shall be amended by adoption of affirmative resolutions by all of the parties to this Agreement. 13 . Withdrawals . Any party shall have the right to withdraw from this Agreement by giving written notice to the Board of Directors of the Southwest Washington Regional Transportation Council . In the event a party withdraws , this Agreement shall be amended accordingly. INTERLOCAL AGREEMENT - 6 01745001.001 (06/04/92) 13 . Withdrawals. Any party shall have the right to withdraw from this Agreement by giving written notice to the Board of Directors of the Southwest Washington Regional Transportation Council. In the event a party withdraws, this Agreement shall be amended accordingly. 14 . Severability. If any of the provisions of this Agreement are held illegal, invalid or unenforceable, the remaining provisions shall remain in full force and effect. The City of North Bonneville's request is the first since RTC was established in July of 1992. The Mayor of North Bonneville, John Kirk, has initiated this request. Mayor Kirk's interest in being a member of RTC is based on his recognition of the important role RTC plays in transportation issues in Southwest Washington and is hopeful that RTC can help his small community find additional transportation resources. The number of seats on the RTC Board would not change with this action because there is currently one representative on the RTC Board of Directors, for all member agencies in Skamania County. Skamania County Commissioner Judy Carter holds this seat. North Bonneville would be a voting member of the Skamania Transportation Policy Committee which meets monthly in Stevenson. The same situation is true for Klickitat County, their individual members and the K.lickitat County Transportation Policy Committee. In summary, the change that would occur with this request is that North Bonneville would become a member of RTC and a voting member of the Skamania County Transportation Policy Committee. POLICY IMPLICATION The existing members of the Skamania County Transportation Policy Committee which include Skamania County, Stevenson, Port of Skamania County and WSDOT support the addition of North Bonneville to their committee. The regional transportation planning and decision process is strengthened throughout the Columbia River Gorge with the addition of another general- purpose local government being added into the process. RTC's Interlocal Agreement provides for the addition of new members by consent of all parties to the Agreement. This would indicate the requirement for a unanimous vote by the RTC Board plus a sign off by the other RTC members who do not sit on the Board. Hence, these additional entities would also be asked for their approval.
