AN ORDINANCE reenacting Ordinance No . 2246 ,
adding a new section to Chapter 3 . 84 by imposing an
additional excise tax of one - quarter ( 1 /4 ) of one ( 1 % )
percent on the sale of real estate within the corporate
limits of the City of Camas as authorized by RCW

WHEREAS , on November 22 , 1999 , the City Council enacted Ordinance No . 2246 , which
imposed an additional excise tax of one - quarter ( 1 /4 ) of one ( I % ) percent on the sale of real estate
within the City of Camas , and
WHEREAS , Washington voters have approved Initiative 722 , which in part invalidates all
tax and fee increases adopted by local governments between July 2 , 1999 , and December 31 , 1999 ,
and
WHEREAS , several cities have filed suit challenging the constitutionality of Initiative 722 ,
and
WHEREAS , due to the uncertainty surrounding the passage of Initiative 722 and the legal
challenges thereto , the City desires to reenact the increase in the real estate excise tax ,
NOW , THEREFORE , THE COUNCIL OF THE CITY OF CAMAS DO ORDAIN AS
FOLLOWS :
Section I
Ordinance No . 2246 , which imposed an additional excise tax of one - quarter ( 1 /4 ) of one
percent ( I % ) on the sale of real estate within the City of Camas , is hereby reenacted , confirmed
and ratified effective January 1 , 2000 .
Section II
There is hereby added to Chapter 3 . 84 of the Camas Municipal Code a new section to
provide as follows :
3 . 84 . 015 - Additional Real Estate Excise Tax
In accordance with RCW 82 . 46 . 035 , and in addition to the excise tax on the sale of
real property imposed by Section 3 . 84 . 010 of the Camas Municipal Code , there is
hereby imposed an excise tax on each sale of real property located within the
corporate limits of the City of Camas at the rate of one - quarter ( 1 /4 ) of one ( I % )
percent ( 0 . 25 % ) of the selling price to be collected by Clark County as prescribed
in RCW 82 . 46 . 060 . Proceeds from this additional tax shall be deposited in a
separate account in the Growth Management Capital Proj ects Fund and expended
only as authorized by law under RCW 82 . 46 . 035 ( 5 ) .

Section III
If any section , clause or phrase of this ordinance is declared unconstitutional or invalid for
any reason , such decision shall not affect the validity of the remaining portions of the ordinance .
Section IV
This ordinance shall take force and be in effect five ( 5 ) days from and after its publication
according to law .
