2196ORDINANCENO.2/74ANORDINANCEamendingSection2.06.010oftheCamasMunicipalCodebyrevisingtheprocedureforappointmentandremovaloftheCityAdministratortorequiretheconsentofamajorityoftheCityCouncil.THECOUNCILOFTHECITYOFCAMASDOORDAINASFOLLOWS:SectionISection2.06.010oftheCamasMunicipalCodeisamendedtoprovideasfollows:2.06.010-PositionCreatedThereisherebycreatedthepositionofCityAdministrator,whoshallbeandactastheadministrativeandexecutivesupervisorofthecitygovernmentundertheauthorityanddirectionoftheMayor.ThepositionofCityAdministratorshallbefilledbyappointmentoftheMayorwiththeconsentandapprovalofamajorityoftheCityCouncil.ThepositionofCityAdministratorshallbeanatwillposition;anypersonsoappointedtothepositionofCityAdministratorshallserveatthepleasureoftheMayor,andmayberemoved,withorwithoutcause,bytheMayorwiththeconsentandapprovalofamajorityoftheCityCouncil.AppointmentofanypersontothepositionofCityAdministratorshallnotbedeemedtohaveconferreduponsuchappointeeanyexpressorimpliedcontractualrighttonoranypropertyinterestorlibertyinterestincontinuedemploymentwiththeCityasCityAdministratororinanyothercapacity.TheCitymay,atitsoption,enterintoaformalcontractwithanypersonappointedasCityAdministrator,providedhowever,thatsuchcontractmaynotvarytheprovisionsofthisordinance.SectionIIThisordinanceshalltakeforceandbeineffectfive(5)daysfromandafteritspublicationaccordingtolaw.LeiPASSEDbytheCouncilandAPPROVEDbytheMayorthis1999.SIGNED:^ytvv/i/\</ClerkATTEST:/.astoform:APPof*1mCityAttorneyy MEMORANDUMMayor,CityCouncilandStaffTO:FROM:RogerKnappCityAdministrator’sPositionRE:September22,1999DATE:MunicipalResearchhasrecentlyinformedusthatOrdinance2196,whichrevisedtheprocedureforappointmentandremovaloftheCityAdministratorbyrequiringtheconsentofamajorityoftheCouncil,mayviolateRCW35A.12.090.Ihaveattachedacopyofthatstatuteforyourreference.MunicipalResearch’sanalysisisessentiallythatRCW35A.12.090expresslyconfersupontheMayortheauthoritytoappointandremoveallappointedofficers.Thatstatutefurthergoesontoprovidethatconfirmationofappointmentsmayberequiredwhenprovidedforbyordinance.Thereisnocorrespondinglanguageregardingremovalfromoffice.IhavethereforerevisedSection2.06.010oftheCamasMunicipalCodetodeletethelanguagewherebytheCityAdministratorcanberemovedwithorwithoutcausebytheMayorwiththeconsentandapprovalofamajorityoftheCityCouncil.Initsrevisedform,theordinanceprovidesforremovalbytheMayoronly.Ihavealsoreviewedourprovisionsrelatingtotheappointmentandremovalofthefirechiefandpolicechief.Undertheapplicableordinances,onlytheMayorhastheauthorityofremoval,andthatislimitedtoremovalforjustcause.AnyappointeetoeitherofthechiefspositionswhoisremovedbytheMayormayappealthatremovaltotheCityCouncilforadeterminationofwhethersufficientjustcauseexiststojustifytheremoval.IamoftheopinionthatthisschemedoesnotcontraveneRCW35A.12.090.TheMayoristheonlypersonauthorizedtoremoveeitherofthechiefs,andhemaydosowithouttheconcurrenceoftheCityCouncil.TheCouncil’sinvolvementisinvokedonlyifanappealisfiled,andthenislimitedtoadeterminationofwhetherjustcauseexists.RDK'-£„
