ORDINANCE NO .
AN ORDINANCE providing for the vacation of a section of the
original NW Parker Street Alignment .
WHEREAS , the City has recently completed construction of the NW Parker Street
extension from NW 38th Avenue northerly to NW Lake Road , and
WHEREAS , during construction , the actual location of NW Parker Street was altered
from its original right of way , and
WHEREAS , by Resolution No . 866 , adopted January 11 , 1999 , the City Council initiated
proceedings to vacate that portion of NW Parker Street not utilized in the actual construction of
the NW Parker Street extension , and
WHEREAS , said Resolution set the 8th day of February , 1999 , at 7 : 00 p . m . , in the
Council Chambers in the City Hall of Camas , Washington , as the time and place for a public
hearing on said proposed vacation , and
WHEREAS , pursuant to said Resolution , the City Clerk caused notices to be posted and
mailed in accordance with the requirements of law , and
WHEREAS , at the time and place set for said hearing , the Council considered the
testimony of all persons commenting on said vacation , and
WHEREAS , the Council finds that that section of NW Parker Street proposed to be
vacated is not currently being utilized for street purposes , and that there are no plans to improve
said portion of NW Parker Street for road purposes , and
WHEREAS , the Council finds that the abutting property owner has dedicated other right
of way for NW Parker of equivalent value to that section of the original NW Parker alignment to
be vacated , now , therefore ,
THE COUNCIL OF THE CITY OF CAMAS DO ORDAIN AS FOLLOWS :
Section I
The following described section of the original NW Parker Street alignment be and the
same is hereby vacated :
Real property situated in the City of Camas , Clark County ,
Washington , being a portion of the Northwest quarter of Section
33 , Township 2 North , Range 3 East of the Willamette Meridian ,
being that portion of Parker Avenue lying Northerly of the
following described line :

Beginning at the most Northerly corner of Parcel I as dedicated by
Wafertech LLC to the City of Camas by deed recorded under
Auditor ' s File No . 9701310001 , records of said county , said point
being on the West right of way line of said Parker Avenue and
being on the arc of a 1040 . 00 foot radius curve ; thence from a
tangent bearing of North 22 ° 23 ' 02 " East , along said curve to the
right , through a central angle of 10 ° 00 ' 49 " , an arc distance of
181 . 76 feet to the most Southerly Northwest corner of Parcel D - 2
as dedicated by the Camas School District 117 to the City of
Camas by deed recorded under Auditor ' s File No . 9705070272 ,
records of said county , said point being on the East right of way
line of said Parker Avenue , and being the terminus of said
described line .
Subject to easements and restrictions of record .
Reserving unto the City of Camas an easement for the
construction , installation , and maintenance of a 21 - inch sanitary
sewer pressure main .
Section II
Said vacation is subject upon the reservation of an easement for sanitary sewer as
described in Section I above .
Section III
Said vacation is contingent upon the abutting property owner paying to the City of Camas
the cost of publication of this ordinance .
Section IV
This ordinance shall take force and be in effect five ( 5 ) days from and after its publication
according to law .
PASSED by the Council and APPROVED by the Mayor this day of February ,
1999 .
