AN ORDINANCE vacating a portion of N . W . 40th Avenue .
WHEREAS , the owner of property abutting N . W . 40th Avenue petitioned the City to
vacate a portion of said Avenue as is more particularly described hereafter , and
WHEREAS , the City Council set August 26 , 1996 , at 7 : 00 p . m . in the Council Chambers
in the City Hall of Camas , Washington , as the time and place for a public hearing on said
proposed vacation , and
WHEREAS , the City Clerk caused notices of said hearing to be posted and mailed in
accordance with the requirements of law , and
WHEREAS , at the time and place set for said hearing , the Council considered the
testimony of all persons commenting on said proposed Avenue vacation , and
WHEREAS , the Council finds that the portion of N . W . 40th Avenue proposed to be
vacated is not currently being utilized for road purposes , and that there are no plans to improve
said portion of N . W . 40th Avenue , now , therefore ,
THE CITY COUNCIL OF THE CITY OF CAMAS DO ORDAIN AS FOLLOWS :
Section I
The following described portion of N . W . 40th Avenue be and the same is hereby vacated :
A tract of land located in the Southeast One - Quarter of Section 33 ,
Township 2 North , Range 3 East , Willamette Meridian , Clark
County , Washington , being more particularly described as follows :
Beginning at a 1/2 inch iron rod marking the southwest corner of Lot
8 of Grass Valley Estates as recorded in Book 4 at Page 441 ,
Records of Clark County , Washington ; Thence South 88 ° 5915411
East along the northerly right - of-- way line of NW 40th Avenue
( formerly SE 18th Way ) a distance of 272 . 16 feet ; Thence North
460 29 ' 15 " East a distance of 14 . 02 feet to a 1/2 inch iron rod , said
iron rod being located on the westerly right - of-- way line of NW
Barlow Court ( formerly SE 230th Court ) ; Thence South 1 ' 58 ' 23 "
West a distance of 39 . 84 feet to the southerly right - of- way line of
said Barlow Court ; Thence North 880 59 ' 54 " West along said
southerly right - of-- way line a distance of 281 . 89 feet to a 1/2 inch
iron rod ; Thence North 10 47 ' 04 " East a distance of 30 - 00 feet to
the POINT OF BEGINNING .
Said tract of land containing 0 . 195 acres , more or less .
Section II
Said vacation is contingent upon the abutting property owner paying to the City of Camas

the cost of publication of this ordinance .
Section III
This ordinance shall take force and be in effect five ( 5 ) days from and after its publication
according to law .
