ORD 2522ORDINANCENO.5-5.23-ANORDINANCEamendingChapter8.12oftheCamasMunicipalCodebyretitlingtheChapteras"VegetationManagement",amendingtreeoverhangrequirements,andproscribingarevisedpenalty.THECOUNCILOFTHECITYOFCAMASDOORDAINASFOLLOWS:SectionISection8.12oftheCamasMunicipalCodeshallhereinafterbereferredtoas"VegetationManagement".SectionIISection8.12.010oftheCamasMunicipalCodeisherebyamendedtoprovideasfollows:Itshallbethedutyofeveryownerandoccupantofanypropertywithinthelimitsofthecitytoremoveordestroyalltrees,plants,shrubsorvegetation,orpartsthereof,whichoverhanganysidewalkataheightoflessthantenfeet,orwhichoverhanganystreetataheightlessthanfourteenfeet,orwhicharegrowingthereonoruponthesidewalkorparkingstripareaabuttingsuchpropertyinsuchamannerastoobstructorimpairthefreeandfulluseofthesidewalkorstreetbythepublic.Itshallbethefurtherdutyofeverysuchownerandoccupanttoremoveordestroyallgrass,weeds,shrubs,bushes,treesorvegetationgrowingorwhichhasgrownanddieduponsuchproperty,oruponthesidewalk,orparkingstripareasabuttinguponsuchproperty,whichareafirehazard,eitherpresentorpotential,oramenacetopublichealth,safetyorwelfare.SectionIIISection8.12.020oftheCamasMunicipalCodeisherebyamendedtoprovideasfollows:ItshallbethedutyoftheCodeComplianceOfficer,FireChief,ordesigneetomakeinspectionsofvacantlotsandotherpropertieswithinthecitylimitstodeterminewhethertheobligationsimposedbySection8.12.010arebeingfulfilled.Intheeventalotortractofpropertyisdiscovereduponwhichisgrowing,orhasgrownanddied,anysuchvegetationasisdescribedinSection8.12.010,thefiredepartmentshallprepareawrittennoticetotheowneroroccupantofsuchproperty,whichnoticeshalldescribethepropertyinvolvedandthehazardouscondition,andshallrequiretheowneroroccupanttoremoveordestroysuchvegetationwithintendaysafterreceiptofsuchnotice.Suchnoticeshallbeservedbymailingacopythereoftotherecordownerofsuchpropertyathislastknown
Page-2OrdinanceNo.addressasshownbytherecordsintheofficeoftheassessorofClarkCountyandbypostinganadditionalcopythereofontheproperty.SectionIVSection8.12.030oftheCamasMunicipalCodeisherebyamendedtoprovideasfollows:Intheeventthattheremovalordestructionofsuchvegetationisnotmadebytheowneroroccupantwithinsuchten-dayperiod,thecity,underthedirectionofthedirectorofpublicworksorfirechief,shallprovidefororremovesuchvegetationeitherbycityworkforcesorundercontractwithaprivateparty.Anaccountingofthecostofsuchworkshallbekeptandreportedtothedirectorofthefinancedepartmentwhentheworkiscompleted.Thecosttothecityofsuchworkshallbeandbecomeacharge,againsttheownerofthepropertyandalienagainsttheproperty.SectionVThisordinanceshalltakeforceandbeineffectfive(5)daysfromandafteritspublicationaccordingtolaw.PASSEDbytheCouncilandAPPROVEDbytheMayorthisi7^dayof2008.SIGNED:LMayorATTEST:ClerkAPPROVEDastoform:-9KCityAttorney
