This Agreement is subject to all consistent terms and conditions of that certain Master Interlocal Mutual Law Enforcement Assistance Agreement ("Master Agreement") executed in 2000 by the parties, and recorded with the Clark County Clerk' s Office under Recording Number 3379036, except as expressly provided herein. Therefore, for and in consideration of the following covenants, the parties agree as follows .9 10 Effective Date and Duration. This Agreement shall be effective from the date the Agreement is executed by at least two parties and shall renew automatically on the first day of each following January thereafter unless terminated in accordance with the provisions of the Master Agreement between the parties . 2e PuMose and Function . The purpose of this Agreement is to establish guidelines and cost recovery methods for investigations conducted by the Vancouver Police Department (VPD) Computer Forensics Lab (CFL) . 3 . Comnuter Forensics Lab. The CFL unit consists of one full-time Investigator who reports directly to the Investigations Division Commander. The mission of the VPD-CFL is to provide computer forensic retrieval and analysis of data from computers used or suspected of being used in the commission of a crime. The CFL prioritizes cases by types of crimes with person crimes (including crimes against children) usually worked before property crimes. However, that does not mean that property crimes are treated as a lesser crime, since child pornography is often found in the collection of property crime investigations. Procedures and Guidelines. ) Prioritization. The CFL Investigator and the Investigations Division Commander and/or his/her designee will triage and prioritize investigative needs by assessing work load issues as well as the a immediacy of each case . . Outside Agency_ equests. All outside agency requests may be submitted to the CFL Investigator and/or the Investigations Commander. The CFL Investigator, with the knowledge and concurrence of the CFL Commander, may acceptand/or reject requests . Each case will be reviewed, accepted or rejected, and prioritized based on the nature of the request and pending CFL caseloads. c) Tracking. The CFL Investigator will provide a CFL tracking number for each case and a summary of hours spent working on each case . The summary will include regular and overtime hours spent working, and any costs associated with specific cases. 50 Budget and Finance. a) Billing Period. VPD will send a summary statement and bill either quarterly or upon completion of adjudication. Payment shall be made to the Vancouver Police Department-Computer Forensics Lab fund or as designated by the Vancouver Police Department Police Chief. b) Costs 2004 numbers) CFL HourlyRate : $40 .22 CFL Overtime Hourly Rate : $58 . 00 Consumables/overhead : $ 15 . 00 each case Expenses related to cases requiring specific or specialized hardware or software, not available in the CFL, may be charged to the requesting/submitting agency. Final billing will be made upon termination of this agreement and payment will be made no more than 60 days past the termination date.
