ORD 24-001ORDINANCE NO. 24-001 AN ORDINANCE providing for the vacation of a portion of city owned property at 600 NW 18 th Loop for the benefit of 1804 NW Edgehill Drive. WHEREAS, on September 14, 2023 the owners of real property located at 1804 NW Edgehill Drive submitted a request to vacate an adjacent portion of city owned property at 600 NW 18 th Loop; and WHEREAS, on December 18, 2023, the City Council adopted a Resolution setting a public hearing on January 16, 2024 at 7:00 p.m., in the Council Chambers in the City Hall of Camas, Washington, as the time and place for a public hearing on said vacation request; and WHEREAS , pursuant to said Resolution , the City Clerk caused notices to be posted and mailed in accordance with the requirements of law; and WHEREAS, at the time and place set for said hearing, the Council considered the testimony of all persons commenting on said vacation; and WHEREAS , the Council finds that the portion of property within 1804 NW Edgehill Drive as proposed to be vacated is not currently being utilized for public water and sewer use, that said portion of the vacated property is more suitable for private use, and that here shall be a sewer easement placed over the vacated property to the city's benefit to access sewer infrastructure. NOW, THEREFORE, THE COUNCIL OF THE CITY OF CAMAS DO ORDAIN AS FOLLOWS: Section I That portion of 600 NW 18 th Loop shown in Exhibit "A" attached hereto and by this reference incorporated herein be and the same is hereby vacated, subject to the city retaining a sewer easement for purposes of accesss to utility infrastructure. Section II Said vacation is contingent upon the abutting landowner paying the cost of publishing this ordinance and paying the sum of $10,500 to the City. Section III This ordinance shall take force and be in effect five (5) days from and after its publication according to law.
