RES 1249RESOLUTION NO./^?V ^A RESOLUTION approving a Development Agreement between the City of Camas and Gary E.Houts,Bobbi J .Houts,Richard C. Marshall,Cassandra R.Marshall ,Lee A .Weiberg,and Linda G . Weiberg. WHEREAS,Gary E.Houts,Bobbi J.Houts,Richard C.Marshall,Cassandra R.Marshall,Lee A .Weiberg,and Linda G .Weiberg,are owners of certain real property located within the City of Camas (hereinafter referred to as “Lot Owners”);and WHEREAS,the City of Camas and the Lot Owners have negotiated a Development Agreement;and WHEREAS,the Development Agreement sets forth certain development standards that will govern the development of the property;and WHEREAS,the City Council has conducted a public hearing,as required by law,on the proposed Development Agreement,at which time it considered testimony from all interested parties; and WHEREAS,the City Council finds that the Development Agreement has been reviewed by the Director of Community Development and has been found to meet all applicable planning requirements;and WHEREAS,the City Council desires to approve the Development Agreement; NOW,THEREFORE,BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAMAS AS FOLLOWS: Section I That certain Development Agreement between the City of Camas and Lot Owners,relating to certain real property located with the City’s municipal boundary,is hereby approved,and the Mayor is authorized and instructed to sign the Development Agreement on behalf of the City. Section II The Development Agreement shall be recorded with the Clark County Auditor,pursuant to the requirements of RCW 36.70(B).190. WHEREAS,theCityisaWashingtonMunicipalCorporationwithlanduseplanningandpermittingauthorityoveralllandwithinitscorporatelimits;and,WHEREAS,theCity,hastheauthoritytoenterintoDevelopmentAgreementspursuanttoRCW36.70B.170;and,TheLegislaturefindsthatthelackofcertaintyoftheapprovalofdevelopmentprojectscanresultinawasteofpublicandprivateresourcesescalatehousingcostsforconsumersanddiscouragethecommitmenttocomprehensiveplanningwhichwouldmakemaximumefficientuseofresourcesattheleasteconomiccosttothepublic.Assurancetoadevelopmentprojectapplicantthatupongovernmentapprovaltheprojectmayproceedinaccordancewithexistingpoliciesandregulations,andsubjecttoconditionsofapproval,allissetforthinadevelopmentagreement,willstrengthenthepublicplanningprocess,encourageprivateparticipationandcomprehensiveplanning,andreducetheeconomiccostofdevelopment;and,WHEREAS,theCityisfurtherauthorizedtoenterintoDevelopmentAgreementpursuanttoCamasMunicipalCode(“CMC”)18.55.340;andNOW,THEREFORE,THEPARTIESHERETOAGREEASFOLLOWS:Section1.DevelopmentAgreement.ThisAgreementisaDevelopmentAgreementtobeimplementedinaccordancewithRCW36.70B.170throughRCW36.70B.210andCMC18.55.340.ItshallbecomeacontractamongstLotOwnersandtheCityupontheCity’sapprovalbyordinanceorresolutionfollowingapublichearingasprovidedforinRCW36.70B.170andCMC18.55.340andexecutionoftheAgreementbyallParties.Section2.Thepartieswishtoenterintothisagreementwiththeintentto:A)AcknowledgethelotsaforementionedarelegallotsofrecordandmaybedevelopedconsistentwiththeCamasMunicipalCode;B)SetforthaprocessbywhichthepublicrightofwaywithintheProperty(approximately0.67acres)maybevacatedandtoestablishalternativeacceptableegress/accesstotheProperty;C)Providefortheconveyanceofapproximately1.47acresoflandfromLotOwnerstotheCityofCamasforpublicrecreationalandnaturalopenspacepurposes;and,D)SetforthLowImpactDesignStandardsbywhichdevelopmentoftheProjectwilloccur.Purpose.EffectiveDateandDurationofAgreement.Section3.ThisAgreementshalltakeeffectimmediatelyuponitsadoptionbytheCityCouncilandexecutionbyallparties,providedthatanytimeperiodsspecifiedinthisAgreementshallbe tolledpendinganyappealsofanycity,stateorfederallandusedecisionsnecessarytocommenceandtocarryoutthetermsoftheAgreement.Thetermofthisagreementshallbesevenyears.Section4.ROWVacationCityagreestoutilizeitsbesteffortstoscheduleandholdapublichearingtoconsideraroadvacationofthatportionofpublicrightofwayknownasNW5thPlacelocatedwithintheGlenwoodHeightsAddition,consistentwithadoptedregulationsandstatutes.CityagreestosubmitforallocationbyClarkCountythevacatedrightofwaygenerallyconsistentwithExhibit“B”,withoutpaymentofmonetaryconsiderationotherthanthecostofpublicationoftheapplicableordinanceandClarkCountyrecordingfees.UponavacationofNW5thPlace,LotOwnersagree:A.TosubmittotheCitycopiesofallproposedeasementsforCityreviewandapprovalpriortorecordingwithClarkCounty;B.Toestablisheasementsforingress,egressandutilities20feetinwidthpriortothesaleorhomeconstructionofLots1-3,2-3,3-3,4-3,5-3,3-2,4-2,5-2,generallyconsistentwithExhibit“C”;C.TosubmittotheCityforapprovalconcurrentwithCityreviewofeasements,aparkingplandetailinghowvehiclesblockingorobstructingegressoraccesswillberemovedandenforced;D.AddressingshallbeoffofNW5AvenueandapprovedaddressmonumentsestablishedatthepointofaccessalongNW5Avenue;E.AllresidentialstructuresshallhavelifesafetyfiresprinklersinstalledperNFPA13D;F.Internalprivateroadwaysshallbeaminimum12feetinwidth,havefinishedgradesupto12%wherefeasible(nottoexceed15%atanyportion),beofasphalt,concreteorotherhardanddurablesurfaceacceptabletotheCityEngineerandFireMarshall.Witheachbuildingpermitsubmittal,aroadway/drivewayplanshallbesubmittedtotheCityforreviewandapprovalbytheCityEngineer.TheCityreservestheabilitytodeterminethelengthandconfigurationofroadwayimprovementnecessarytoservesaidlot.Partiesagreethatinternalroadwaysanddrivewaysshallnotbegated.Section5.LotDevelopmentandLowImpactDevelopmentLotOwnersagreetodevelopindividuallotsinamannerconsistentwithLowImpactDevelopmentStandardsasspecifiedinthe2005LowImpactDevelopment-TechnicalGuidanceManualforPugetSoundorasamended.Wherepracticalthefollowingpracticeswillbeemployed:1)Maintainexistingnaturalvegetationandtreecover;2)minimizelandclearingactivities;3)Minimizebuildingfootprints;and4)Minimizeimpervioussurfaces. PartiesagreesetbacksforeachlotshallbeestablishedwiththisagreementconsistentwiththebuildingenvelopesandlotcoveragestandardsidentifiedonExhibit“C”.Notwithstandinglotsize,PartiesfurtheragreethateachlotshallbedevelopedinaccordancewiththesmalllotdevelopmentstandardsforstormwaterinaccordancewiththemostcurrentCamasDesignStandardsManual.Section6.PublicRecreationalandNaturalOpenSpace.UponCityCouncilapprovalvacatingrightofwayunderSection4,Partiesagreetoexecuteadeedofdedication,whichdedicates,conveys,andwarrantsuntotheCityofCamasapproximately1.47acresasgenerallydepictedonExhibit“D”forthepurposesofpublicrecreationandnaturalopenspaceprotection.LotOwnersshallprovideaformoflegaldescriptionforreviewanduseinthistransactionwithin45daysofexecutionofthisAgreement.Cityshallexecuteanyandalldocumentsnecessaryforsaidconveyance.Section7.Failurebyeitherpartyatanytimetorequireperformancebytheotherpartyofanyoftheprovisionshereofshallinnowayaffecttheparties'rightshereundertoenforcethesame,norshallanywaiverbyapartyofthebreachhereofbeheldtobeawaiverofanysucceedingbreachorawaiverofthisnon-waiverclause.Waiver.Section8.ThisAgreementshallbeconstruedinaccordancewith,andgovernedby,thelawsoftheStateofWashington.ThepartiesagreetovenueintheSuperiorCourtforClarkCounty,StateofWashington,toresolveanydisputesthatmayariseunderthisAgreement.Venue.Agreement/Modifications.ThisAgreementcannotbeamendedormodifiedSection9.withoutawritingsignedbyallofthePartieshereto.Captions.ThecaptionscontainedinthisAgreementwereinsertedfortheSection10.convenienceofreferenceonly.Theydonotinanymannerdefine,limit,ordescribetheprovisionsofthisAgreementortheintentionsoftheParties.Gender/Singular/Plural.Whenevermasculine,feminine,neutral,singular,plural,conjunctive,ordisjunctivetermsareusedinthisAgreement,theyshallbeconstruedtoreadinwhateverformisappropriatetomakethisAgreementapplicabletoallthePartiesandallcircumstances,exceptwherethecontextofthisAgreementclearlydictatesotherwise.Section11.Section12.Severability.IfanyportionofthisAgreementshallbeinvalidorunenforceabletoanyextent,thevalidityoftheremainingprovisionsshallnotbeaffectedthereby.Section13.InconsistenciesIfanypropertyidentifiedunderthisagreementisnotownedbyLotOwnersatthesigningofthisagreement,saidpropertyshallnotbevestedorentitledtoanyrightsunderthisagreement.
