RES 1248RESOLUTION NO. A RESOLUTION setting a public hearing concerning the proposed vacation of right-of-way within the Glenwood Heights Addition WHEREAS,the City has received a request from Lee and Linda Weiberg,Richard and Cassandra Marshall ,and Gary and Bobbi Houts to vacate the right-of -way known as NW 5 th Place within the Glenwood Heights Addition ,and WHEREAS,the portion of said right-of-way to be vacated is abutted by properties owned by Lee and Linda Weiberg,Richard and Cassandra Marshall,and Gary and Bobbi Houts,and WHEREAS,the Council of the City of Camas desires to initiate vacation proceedings for the right-of-way to be vacated ,and WHEREAS ,it is necessary for the Council to fix a time and place for a public hearing to be held on the proposed right-of-way vacation . NOW ,THEREFORE,BE IT RESOLVED BY THE COUNCIL FOR THE CITY OF CAMAS AS FOLLOWS : Section 1 The Council of the City of Camas does hereby initiate proceedings to vacate the following described portion of public right-of-way described in Exhibit “A”attached hereto and by this reference incorporated herein . Section II A public hearing shall be held on the proposed vacation on the 20 th day of August 2012 , at 7:00 p.m.in the Council Chambers of the City Hall. Section III The City Clerk is directed to give twenty (20)days notice of the hearing by posting written notice in three of the most public places in the City of Camas,by posting a like notice on that portion of the street to be vacated ,and by mailing notice to the abutting property owners at least (15 )days prior to the date of hearing.//ADOPTED at a regular session of the City Council of the City of Camas this 16 th day of July 2012 . 4SIGNED: ayor r\/<ATTEST : Clerk/f /i City Attorney EXHIBIT “A” Page 1 of 2 RIGHT-OF-WAY VACATION -NW 5TH PLACE That portion of public right-of-way tract lying north of the northernmost right-of-way line of NW 5 th Avenue designated as NW 5th Place on GLENWOOD HEIGHTS ADDITION To the City of Camas,Washington ,according the plat thereof,recorded in Book “D”of Plats,page 103,records of Clark County ,Washington,said tract being located in the East Half of the East Half of the Southwest Quarter of Section 10,Township 1 North ,Range 3 East,Willamette Meridian . Said public right-of-way tract containing 29,600 square feet,more or less. EASEMENT -NW 5 PLACE An easement to the City of Camas in ,over,and across the easternmost 35 feet of said public right -of-way for the purpose of accessing,maintaining,and replacing a public sewer main .
