RES 97377 -3RESOLUTIONNO.
A RESOLUTION amending Resolution No.969 which
adopted a moratorium for the acceptance of development
applications for property located within 1,000 feet of any of the
City’s municipal water wells,by implementing a process for
affected persons to apply for an exemption from the moratorium.
WHEREAS,on August 25,2003,the City Council adopted Resolution No.969 which
imposed a moratorium for the acceptance of development applications for property located
within 1,000 feet of any of the City’s municipal water wells,and
&WHEREAS,on OctoberJ .4'2003,the City held a public hearing on said moratorium as
required by RCW 36.70A.390,and
WHEREAS,as a result of said public hearing,it appears that the moratorium as drafted
may be overly broad in that it precludes activities that would have no impact on the water quality
or the City’s well system,and
WHEREAS,the Council desires to adopt a process for exemptions to the moratorium,
NOW,THEREFORE,be it resolved by the Council of the City of Camas as follows:
Section I
Any person aggrieved by the moratorium imposed by Resolution No.969 may apply to
the Public Works Director for an exemption.The applicant shall have the burden of establishing
that the proposed development activity will not cause any degradation to water quality or
otherwise adversely impact the municipal water system.In rendering a decision,the Public
Works Director shall utilize the Department of Ecology Storm Water Management Guidelines
for Western Washington,including best management practices for source controls and runoff
treatment,and the Department of Ecology Storm Water Pollution Plan for Industrial Facilities
best management practices.If the Public Works Director finds that the applicant has met this
burden,then the Public Works Director shall issue a written decision granting an exemption from
the moratorium and directing the issuance of a permit for the development activity.In granting
an exemption,the Public Works Director may impose such conditions as are necessary and
appropriate to protect water quality and to prevent adverse impact to the municipal water system.
The decision of the Public Works Director may be appealed to the City Council by
written notice filed within ten (10)days of the Public Works Director’s decision.The City
Council shall hear the matter de novo.
