RE:Competitive Bidding Statute and Sole Source Vendor for Library Conveyer
System
At the request of Library Director Zavortink,I have prepared a resolution authorizing thepurchaseofasteepinclineconveyersystemforthelibrarywithoutgoingthroughthecompetitive •bidding process.RCW 39.04.280 sets forth some exemptions to the competitive biddingrequirements, including purchases that are clearly and legitimately limited to a single source ofsupply. In order to adopt the resolution in question, you need to find that if legitimatespecificationsweredrawnfortheconveyersysteminquestion, only one vendor would be able torespond. It is not permissible to avoid the competitive bidding process simply as a matter ofexpediency. My suggestion would be that you conduct a hearing on the resolution and haveLibraryDirectorZavortinktestifyonpublicrecordastothefactsgivingrisetotheconclusionthatthereisonlyasinglevendoravailable.
