RES 915RESOLUTION NO. A RESOLUTION authorizing the Chief of Police of the City of Camas Police Department to execute a Notice of Consent to agencies authorized to exercise peace officer powers pursuant to the Washington Mutual Aid Peace Officers Power Act,RCW Chapter 10.93 and further ratifying all agreements made thereunder pursuant to the Interlocal Cooperation Act,RCW Chapter 39.34. WHEREAS,RCW Chapter 10.93,the Washington Mutual Aid Peace Officers Power Act,authorizes the Chief of Police of the City of Camas Police Department to provide prior written consent to all general authority law enforcement officers within the State of Washington the power to enforce criminal traffic laws within the jurisdiction of the City of Camas;and WHEREAS,attached hereto as Exhibit “A”is a copy of the Notice of Consent form to be signed by the Chief of Police of the City of Camas Police Department;and WHEREAS,attached hereto as Exhibit “B”is a list of agencies authorized to exercise peace officer powers who will receive the Notice of Consent executed by the Chief of Police of the City of Camas Police Department;and WHEREAS,the council of the City of Camas hereby ratifies all agreements among the local governmental entities listed in Exhibit “B”which are necessary to comply with the Notice of Consent to be issued pursuant to the Washington Mutual Aid Peace Officers Power Act; NOW,THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAMAS AS FOLLOWS : 1.The Chief of Police of the City of Camas Police Department,is hereby authorized to execute the Notice of Consent form issued pursuant to the Washington Mutual Aid Peace Officers Power Act,RCW Chapter 10.93,which form is attached hereto as Exhibit “A”. 2.The Notice of Consent to be executed by the Chief of Police of the City of Camas Police Department,may be provided to the agencies authorized to exercise peace officers powers as listed in Exhibit “B”. 3.The council hereby ratifies all agreements with the agencies listed in Exhibit “B” which are necessary to comply with the Washington Mutual Aid Peace Officers Power Act, RCW Chapter 10.93. .c)\5ResolutionNo Page 2 iPASSEDbytheCouncilandAPPROVEDbytheMayorthisI 2001 . Respectfully, Donald E.Chaney Chief of Police Camas Police Department Enclosure:Notice of Consent DEC;glm CAMAS POLICE DEPARTMENT 2100 N.E .3rd Ave .,Camas,Washington 98607 360-834-4151 CAMAS ©POLICE DEPT NOTICE OF CONSENT Issued pursuant to the Washington Mutual Aid Peace Officers Power Act Chapter 10.93 Chapter 89,Washington Laws of 1985,Regular Session,became effective on July 1, 1985.Under Subsection 1 of Section 7 of that Act,general authority law enforcement officers with appropriate training certificates (or exemption therefrom)may enforce criminal traffic laws any place in the State “upon the prior written consent of the Sheriff or Chief of Police in whose primary territorial jurisdiction the exercise of powers occurs.” In accordance with Chapter 89,Section 7(1)and RCW 10.93,I hereby consent to the full exercise of peace officer powers within the jurisdictional boundaries of Clark County by any and all properly certified or exempted officers of the agencies designated in this agency’s current “list of Agencies Authorized to Exercise Peace Officer Powers,“a copy of which is maintained in our office,which includes your agency.The list of authorized agencies may be modified from time to time to add or delete agencies .This agency shall maintain a current list of authorized agencies on file with this Notice of Consent. Any liability or claim of liability which arises out of the exercise or alleged exercise of authority by an officer of the authorized agency under Chapter 89 and RCW 10.93 and pursuant to this Notice of Consent is the responsibility of that agency unless the liability is otherwise allocated under a written agreement between the authorized agency and another agency. This consent is valid during my tenure as the Chief of Camas Police Department.This consent is not intended to reallocate,under Section 4 of Chapter 89 and RCW 10.93,the responsibilities of the listed agencies for the acts or omissions of their officers.
