ORD 2306 ORDINANCE NO , AN ORDINANCE amending Section 18 . 43 . 050 of the Camas Municipal Code by amending the criteria for conditional use permits , and adding a new section to 18 . 43 establishing special conditions for licensed liquor establishments in the downtown commercial zone . THE COUNCIL OF THE CITY OF CAMAS DO ORDAIN AS FOLLOWS : Section I Section 18 . 43 . 050 of the Camas Municipal Code is amended to provide as follows : 18 . 43 . 050 - Criteri' The Planning Commission and Council shall be guided by all of the following criteria in granting or denying a conditional use permit : A . The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is situated ; Be The proposed use shall meet or exceed the development standards that are required in the zoning district in which it will occupy ; C . The proposed use shall be compatible with the surrounding land uses in terms of traffic and pedestrian circulation , building and site design ; D . Appropriate measures have been taken to minimize the possible adverse impacts that the proposed use may have on the area in which it is located ; E . The proposed plan is consistent with the goals and policies expressed in the Comprehensive Plan ; F . Any special conditions and criteria established for the proposed use have been satisfied . In granting a conditional use permit the Planning Commission and Council may stipulate additional requirements to carry out the intent of the Camas Municipal Code and Comprehensive Plan . Section II There is hereby added to Chapter 18 . 43 a new section to provide as follows : 18 . 43 . 115 - Special Conditions and Criteria for Licensed Liquor Establishments in the Downtown Commercial Zone A . As used herein , " licensed liquor establishment" shall mean a bar , tavern , cocktail lounge , or any other establishment where alcohol , spirits , beer , wine , or any other alcoholic beverage is served for consumption on premises . Be Licensed liquor establishments where persons under 21 years of age are permitted in all areas open to the public during all hours the establishment is open for business do not require a conditional use permit in the downtown commercial zone . C . Licensed liquor establishments where persons under 21 years of age are not allowed , or where persons under 21 years of age are not permitted to enter some e Ordinance No . , =' Page 2 portion of the establishment otherwise open to members of the public either during all or a portion of the hours the establishment is open for business shall satisfy the following conditions in the downtown commercial zone : 1 . No such establishment shall be permitted within 250 feet of a church , public school , private school , or licensed daycare facility . 2 . There shall be no more than one such establishment per block frontage . Block frontage shall mean one side of the street between intersecting cross streets . 3 . There shall be a maximum of six such establishments permitted in the downtown commercial zone . 4 . The Council may impose additional conditions on live entertainment , outside lounge areas , noise levels , litter and trash , and such other matters as may be necessary to promote the public health , safety and general welfare . Section III This ordinance shall take force and be in effect five ( 5 ) days from and after its publication according to law .
