On January 10 , 2000 , the Camas City Council enacted Ordinance No . 2258 , which
revised the regulations for construction debris cleanup and disposal , provides for the issuance of
a stop work order for violations , provides for the imposition of cleanup costs , and provides a
civil infraction penalty for violations . The Finance Department will mail the full text of the
ordinance to any person upon request .

AN ORDINANCE amending Section 15 . 36 of the Camas
Municipal Code , to allow for the issuance of a stop work order ;
provide for the imposition of cleanup costs ; and providing a civil
infraction penalty for violations .
THE COUNCIL OF THE CITY OF CAMAS DO ORDAIN AS FOLLOWS :
Section I
Section 15 . 36 . 010 of the Camas Municipal Code is amended to provide as follows :
15 . 36 . 010 - Purpose
The purpose of this chapter is to minimize the amount of mud that is tracked onto our
public streets and highways , and to ensure the proper cleanup and disposal of construction
debris .

the development of real estate results in the tracking of mud , and the spillage of
construction debris onto the public streets and highways .
B . Such tracking of mud and spillage of construction debris creates traffic hazards to
users of the public roads and highways , poses a threat to the public safety , and can
result in damage to public property .
C . Tracking of mud , and the consequence of the mud washing off the road surfaces ,
leads to clogged storm drains , culverts and stream channels , inhibits the function of
storm facilities , and causes detrimental water quality issues .

Section II
Section 15 . 36 . 020 of the Camas Municipal Code is amended to provide as follows :
15 . 3 6 . 020 - Definitions
A . " Construction activity" means the clearing , grading , filling , excavation, or any
other land - disturbing activity . The term construction activity shall further mean the
building of any structure or other improvement on real property , the subdivision ,
short platting or other development of real property , and the mining , manufacture
or assembly of construction materials .
B . " Construction debris " means and includes mud , dirt , dust , stumps and vegetation ,
and shall also include all construction materials including but not limited to lumber ,
concrete , sheet rock , masonry, rock , roofing materials , containers and packaging for
construction materials , and other material used in or arising out of a construction
activity .
C . " Construction debris bond " shall mean a bond , cash deposit, or other form of
financial security provided by a developer or a person undertaking a construction
activity . A construction debris bond may be required as part of a construction
debris plan .

D . " Construction debris plan" shall mean an approved plan for the disposal of
construction debris and for the cleanup of construction debris from public streets ,
highways , storm drains , culverts and other public places .
E . " Control measures " means those construction practices designed for the orderly
disposal of construction debris , and for the cleanup of construction debris from the
public streets , highways , storm drains , culverts , and other public places .
F . " Stop Work Order" means an oral or written directive from the director of public
works , or his authorized designee , to cease all construction activity . Upon the
issuance of a stop work order , all work by the person, firm , or corporation in
violation of this chapter or in violation of an approved construction debris plan
must cease , with the exception of authorized control measures pursuant to this
chapter .
Section III
Section 15 . 36 . 030 of the Camas Municipal Code is amended to provide as follows :
15 . 3 6 . 03 0 - Construction Debris Plan and Cleanup Requirements
All persons intending to undertake or undertaking any construction activity shall submit a
construction debris plan to the City . Such plan shall set forth the proposed control measure
for the disposal of construction debris , and for the cleanup up construction debris from
public streets , highways , storm drains , culverts and other public places . The construction
debris plan must be reviewed and approved by the City prior to the commencement of any
construction activity .
Section IV
Section 15 . 36 . 040 of the Camas Municipal Code is amended to provide as follows :
15 . 3 6 . 040 - Enforcement
The director of public works , or his authorized designee , is directed and authorized to
implement and enforce all provisions of this chapter . In enforcing this chapter , the public
works director or his authorized designee shall have the following duties and powers :
A . To require the submission of construction debris plans , and to review and approve
such plans ;
B . To require the submission of a construction debris bond as part of a construction
debris plan when in the j udgment of the public works director or his designee such
bond is necessary to insure compliance with the provisions of this chapter ;
C . To inspect all construction activities to assure compliance with the provisions of
this chapter ;
D . To issue a stop work order of any construction activity being conducted in violation
of this chapter or in violation of an approved construction debris plan . A stop work
order will be in effect until such time as the director of public works , or his
authorized designee , establish that all of the necessary control measures are in place
and are properly functioning .
E . To require any person violating the provisions of this chapter or an approved
construction debris plan to undertake all cleanup , corrective and other remedial
measures necessary to remedy such violation .

Section V
Section 15 . 36 . 050 of the Camas Municipal Code is amended to provide as follows :
15 . 36 . 050 - Failure to Clean Un - City to Perform Work When - Costs
In the event that any developer or person undertaking a construction activity fails to
comply with the provisions of this chapter , then the City may clean up and dispose of
construction debris , clean up spillage of construction debris , or clean up after any
mudtracking . The cost to the City for undertaking these measures shall be a charge against
the person failing to properly dispose of or clean up construction debris , or cleanup
mudtracking . Such charge may be reimbursed to the City from the construction debris
bond deposited by the person undertaking such construction activity , or may be collected
in a civil action maintained in the courts of the state .
Section VI
Section 15 . 36 . 060 of the Camas Municipal Code is amended to provide as follows :
15 . 36 . 060 - Violation - Penalty
Any person , firm , or corporation which violates any provision of this chapter or which
undertakes any construction activity in violation of an approved construction debris plan
shall be guilty of a civil infraction punishable by a stop work order , a fine of not more than
five hundred dollars ( $ 500 . 00 ) per day , or by both such stop work order and fine . Each
separate day or any portion thereof during which any violation occurs or continues shall
constitute a separate offense , and upon conviction thereof shall be punishable as provided
herein .
Section VII
This ordinance shall take force and be in effect five ( 5 ) days from and after its publication
according to law .
