ORD 2657ORDINANCENO.2657ANORDINANCEcondemningforpublicstreetpurposescertainlandlyingwithintheCityofCamasforthepurposeofextendingandconstructingNW38thAvenueandSE20thStreet,THECOUNCILOFTHECITYOFCAMASDOORDAINASFOLLOWS:SectionITheCityCounciloftheCityofCamasherebymakesthefollowingfindings:TheCitydesirestoundertakeastreetimprovementprojectofNW38thAvenueandSE20thStreetfromSEArmstrongStreetto500feeteastofSE192ndAvenue(“thestreetA.improvementproject”).NW38thAvenueandSE20thStreetareclassifiedasregionalarterialstreetsB.whosefunctionistoserveasaprimaryroutetoandfromthecommerciallyandindustriallyzonedpropertiesinGrassValley.Arterialstreetsshouldhaveacapacityof15,000.00to20,000.00carsperday.NW38thAvenueandSE20thStreetarecurrentlyunimprovedruralarterialsC.D.consistingoftwolanesandnoimprovedshouldersorotherrelatedfacilities.ThestreetimprovementprojectproposestowidenNW38thAvenueandSE20thE.StreettothreelanesbetweenSEArmstrongStreetandSEBybeeRoadandbuildanewthreelaneroadbetweenSEBybeeRoadandSE192ndAvenue.Thestreetimprovementprojectfurtherincludesconstructionofcurbs,gutters,F.bikelanes,sidewalks,streetlighting,trafficsignal,andstormwatertreatmentfacilities.ThestreetimprovementprojectisconsistentwiththeCityofCamas20-YearG.GrowthManagementPlans.ThepropertiesdescribedinExhibit“A”anddepictedinExhibit“B”attachedH.heretoandbythisreferenceincorporatedhereinabutthestreetimprovementproject(“thesubjectrealproperties”).TheCityhasbeenunsuccessfulinitsattemptstoacquirethesubjectrealI.propertiesbynegotiation.ThestreetimprovementprojectconstitutesapublicuseundertheprovisionsofJ.RCW8.12.030. OrdinanceNo.2657Page2ThesubjectrealpropertiesarenecessaryforcompletionofthestreetimprovementK.project.L.PursuanttoRCW8.25.290,theCitypublishedandmailednoticetothepropertyownersofthesubjectrealpropertiesthisordinanceauthorizestobecondemned,advisingsuchownersthatafinaldecisioncondemningtherequiredpropertieswouldbemadeattheAugust6,2012,CamasCityCouncilmeeting.AnyandallinterestedpartieshadtheopportunitytoaddresstheCamasCityM.CouncilonthissubjectattheAugust6,2012,meeting.SectionIITheCityisauthorizedtocondemnpropertyandpropertyinterestsforpublicimprovementsunderRCW8.12.030.SectionIIITheCityofCamasherebycondemnsforpublicstreetpurposesthepropertiesdescribedinExhibit“A,”attachedheretoandbythisreferenceincorporatedherein.Condemnationofthepropertiesissubjecttothemakingorpayingofjustcompensationtotheownersinthemannerprovidedbylaw.SectionIVCompensationforthesubjectrealpropertiesshallbepaidfromtheNW38thAvenueConstructionFundoftheCity,andnotbyspecialassessmentuponpropertiesbenefittedbysuchacquisition.SectionVTheCityAttorneyisherebyauthorizedanddirectedtobeginandprosecutetheproceedingsprovidedbylawtocondemn,take,andappropriatetheinterestsnecessarytocarryouttheprovisionsofthisordinance,andisfurtherauthorizedinconductingsaidcondemnationproceedings,andforthepurposeofminimizingdamages,tostipulateastotheuseofthepropertiesherebyauthorizedtobecondemnedandappropriated,andastothereservationofanyrightofuseoftheowneroranypersonentitledtopossessionoftheproperties,providedthatsuchreservationdoesnotinterferewiththeuseofsaidpropertiesasprovidedinthisordinance.SectionVITheCityCouncilherebyfindsanddeclaresthatanemergencyexists,andthisisamatterofurgencywhichnecessitatesthatthisordinancebecomeeffectiveimmediately,inorderto
