AN ORDINANCE providing for the vacation of a portion ofNW
Utah Street, located north ofNW 6th Place, subject to certain
conditions.
WHEREAS, on April6, 2015, the owners of real property described as Lot 23 of Hillside
Terrace II Plat, Lot 80 ofWP Smith DLC and 2229 NW 6th Place, submitted a request to vacate a
portion of NW Utah Street adjacent north ofNW 6th Place, and
WHEREAS, on November 16, 2015, the City Council adopted a Resolution setting a public
hearing on December 7, 2015 at 7:00 p.m., in the Council Chambers in the City Hall of Camas,
Washington, as the time and place for a public hearing on said vacation request, and
WHEREAS, pursuant to said Resolution, the City Clerk caused notices to be posted and
mailed in accordance with the requirements of law, and
WHEREAS, the City heretofore signed an Agreement, recorded under Clark County
Auditor's File No. 5242579 AGR, providing for certain conditions associated with the proposed
vacation including, but not limited to, establishment of a public easement across lots 23 and 80 and
construction of certain drainage ditch improvement within the NW Utah Street right-of-way, and
WHEREAS, at the time and place set for said hearing, the Council considered the testimony
of all persons commenting on said vacation, and
WHEREAS, the Council fmds that the portion ofNW Utah Street as described is more
suitable for private use, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF CAMAS DO ORDAIN AS FOLLOWS:
Section I
That portion ofNW Utah Street adjacent north ofNW 6th Place as described in Exhibit "A"
attached hereto and by this reference incorporated herein be and the same is hereby vacated.
Section II
Said vacation is contingent upon compliance with all conditions as set forth in the Agreement
as referred to herein.
Section III
This ordinance shall take force and be in effect five (5) days from and after its publication
according to law.

ANDERSON PARCEL
That portion of NW Utah Street lying north of NW 6th Street, in Camas WA, more specifically
described as follows:
Beginning at the Northeast corner of Lot 3, in the Book of Short Plats, Page 071 {SP3-071}, Clark
County Auditors Records and the True Point of Beginning;
Thence N 89-31-05 E, a distance of 45.06 feet along the south line of Lot 23, of Hillside Terrace
II, Book H-76, Clark County Auditors Records to a point;
Thence S 00-21-37 E, a distance of 44.39 feet to a point on the northerly right-of-way of NW 6th
Street;
Thence S 71-29-23 W, a distance of 47.42 feet along the northerly right-of-way line of NW 6th
Street to a point;
Thence N 00-21-37 W, a distance of 59.07 feet to the True Point of Beginning, said area
containing 2,331 square feet more or less; and subject to the requirements of the agreement
recorded under Auditor's File Number 5242579, records of Clark County, Washington.
Stormwater Easement
Beginning at the Northeast corner of Lot 3, in the Book of Short Plats, Page 071 (SP3-07lt Clark
County Auditors Records; Thence N 89-31-05 E, a distance of 28.91 feet along the south line of
Lot 23, of Hillside Terrace II, Book H-76, Clark County Auditors Records to the Point of Beginning
and centerline of a fifteen foot (15') wide easement; Thence S 06-36-22 W, a distance of 52.59
feet to a point on the north right-of-way of NW 6th Street and terminus of stormwater
easement.
Access Easement for Lot 3 (SP-071),
An easement is reserved over the vacated portion on NW Utah Street for purposes of access for
Lot 3, in the Book of Short Plats, Page 071 {SP3-071}, described as follows:
The westerly fifteen (15) feet of said NW Utah Street vacation, excepting that portion reserved
for stormwater drainage easement, as described above.
