RES 26-007RESOLUTION NO. 26-007 A RESOLUTION pursuant to RCW 35.94.040 authorizing the vacation of a public waterline easement. WHEREAS, the City of Camas has previously acquired a waterline easement over, under, and across that certain real property for public services, more particularly described in Exhibits "A" and "C", attached hereto and by this reference incorporated herein; and WHEREAS, as relates to the development of the Camas Woods 1 Subdivision site, pursuant to application number SUB 24-1002, the developer has requested that the portion of the public waterline easement located on the subject development, and described in Exhibits "A" and "C" and depicted in Exhibits "B" and "D" attached herein, be vacated; and WHEREAS, RCW 35.94.040 requires that the City adopt a resolution declaring any lands acquired for public utility purposes as surplus to the City's needs; and WHEREAS, the City Council of the City of Camas hereby provides that the area more particularly described in Exhibits "A" and "C" and depicted in Exhibits "B" and "D" which had been reserved to the City for public waterline easement purposes is surplus to the City's needs. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAMAS AS FOLLOWS: SECTION I That area more particularly described in Exhibits "A" and "C" and depicted in Exhibits "B" and "D", attached hereto and by this reference incorporated herein, is hereby deemed to be surplus to the City's needs, and the Mayor or designee is hereby authorized to execute a relinquishment and release of waterline easement for the described area. Resolution No. 26-007 Page -2 SECTION II As consideration for the release and relinquishment, as otherwise described herein, the developer shall remove and dispose of the abandoned pipe in said easement to be vacated.
